Glossary of Complaint History Report Terms

Action: The specific legal action initiated.

Types of actions (click to expand/collapse)
  • Administrative motion/affidavit for further action: Miscellaneous administrative requests for relief.
  • Appeal: An appeal to the Hawaii Supreme Court or the Intermediate Court of Appeals was filed.
  • Assurance of voluntary compliance (AVC)/settled: A written agreement in which the Company or Individual agrees not to engage in further unlawful conduct.
  • Citation issued: A citation for possible unlicensed activity was issued against the Company or Individual.
  • Lawsuit filed: A document filed in court that initiates a lawsuit.
  • Consent judgment filed: A judgment obtained by agreement between the parties was filed.
  • Multi-state activity: The State was a party to an action initiated by several states simultaneously against one or several Companies or Individuals.
  • Order to show cause/subpoena duces tecum motion: A request for a party to show why a certain action should not be taken against that party or a request to enforce a subpoena for documents or testimony.
  • Petition filed: A document filed with the hearings office to initiate disciplinary action.
  • Pre-petition settlement agreement filed: A Settlement Agreement is reached between the parties and filed before a Petition is filed.

Allegation: The claims made against the Company or Individual.

Associated Names: Names that have been used by or are affiliated with a company or individual and are associated with a particular RICO or OCP case.

Company or Proper Name: Name used to identify the company or individual complained about or investigated.

Complaint No.: The prefix and number assigned to a complaint filed with RICO/OCP against a Company or Individual.

Compliance Date: The date on which a Company or Individual has complied with or satisfied an order or agreement.

Master Case: The master case is used to identify a legal action or legal actions. There can be multiple legal actions under one master case.

Other Names: Names that have been used by or are affiliated with a company or individual, but are not associated with a particular RICO or OCP case.

Outcome: The result of the lawsuit, petition, or investigation.

Types of outcome (click to expand/collapse)
  • Addressed Expeditiously: The Individual or Company against whom the complaint was filed resolved the consumer problem promptly.
  • Advisory contact: The investigation did not determine that a violation of law occurred, but the business was contacted and advised of the applicable laws.
  • Appeal taken: Occurs when a board order is appealed to court and is either affirmed or remanded by the court.
  • Assurance of voluntary compliance (AVC)/settled: A written agreement in which the Company or Individual agrees not to engage in further unlawful conduct.
  • Board's order issued: The issuance of an Order or decision by a Board.
  • Board's order issued and confirmed: A Board's order that has been issued is confirmed as a judgment in circuit court.
  • Business v. business: Occurs when a business, rather than a consumer, complains about another business.
  • Civil: The case may involve a financial or other dispute between the parties.
  • Citation issued: The citation for possible unlicensed activity was issued against the Company or Individual.
  • Citation dismissed: The citation was set aside voluntarily by RICO or set aside by the hearings officer after a hearing was conducted.
  • Citation issued and confirmed: The citation was confirmed in circuit court as a judgment either after a hearing was held on the case or without a hearing being held on the case.
  • Complainant uncooperative/unavailable: The consumer who fills out the complaint form becomes unavailable or refuses to cooperate.
  • Consent judgment dismissed: The dismissal of a judgment that was obtained by agreement between the parties.
  • Final order: Occurs when a Board issues a final written decision in a case.
  • Insufficient evidence: The information/evidence gathered during the investigation does not establish that a violation of the law occurred.
  • Judgment: A civil award of an injunction, fines, and/or restitution that is obtained: 1) without a civil law suit being filed and to which the parties have agreed; 2)after a civil lawsuit has been filed, either before or after a trial, and to which the parties have agreed; 3)when a party to the lawsuit fails to respond to the action in a timely manner; 4) either before or after a trial is conducted in the case; or 5) after the filing of a civil lawsuit when there are no material issues of fact or law.
  • Judgment/order on order to show cause or subpoena: The judgment or order rendered as a result of a motion for an Order to Show Cause or Subpoena.
  • Lawsuit dismissed: The document initiating a lawsuit in court was set aside voluntarily or set aside by the court.
  • Motion dismissed: A party's request for a particular result is dismissed.
  • Motion withdrawn: A party's request for a particular result is withdrawn by the requesting party.
  • Multistate activity: The State was a party to an action initiated by several states simultaneously against one or several Companies or Individuals.
  • No jurisdiction: RICO/OCP does not have authority to take action in the case because the case does not concern a matter that RICO/OCP regulates.
  • No violation: The case does not involve a violation of the state's applicable laws.
  • Order denying order to show cause: A decision denying a party's request for a particular result against the opposing party.
  • Order granting order to show cause: A decision granting a party's request for a certain result against the opposing party.
  • Pending: The case is being investigated, legal action is being considered, or legal action has been initiated and is currently unresolved.
  • Petition dismissed: The petition for disciplinary action was set aside voluntarily by RICO or set aside by the hearings officer after a hearing was conducted.
  • Prior action taken: Legal action for the same or similar conduct was previously taken or was previously issued in another case against the same Individual or Company.
  • Remand: The case was sent back for further proceedings at the hearing or board level.
  • Removed to another court: The matter has been transferred to another court.
  • Resolved: The case has been settled between the parties and/or between RICO/OCP and the parties.
  • Resolved through mediation: The case is settled or resolved through mediation.
  • Settlement agreement and order: An agreement entered into between RICO and the Company or Individual before or after the filing of a petition for disciplinary action that is approved by the board or commission.
  • Settlement agreement rejected: Occurs when a settlement agreement is set aside.
  • Threshold: The case was an isolated incident and the monetary loss was minimal. The case is being kept on file for future reference.
  • Transmitted to another agency: The case was sent to another state, county, or federal agency for review and possible legal action.
  • Unable to proceed-r dead/unlocatable: The Company or Individual is either deceased, cannot be located, out of business, or filed for bankruptcy.
  • Warning letter: A letter of warning sent to a Company or Individual, outlining the requirements of the laws.
  • Withdrawal/dismissal of order to show cause: A request that a party show why a certain action should not be taken against that party is withdrawn by the requesting party or dismissed by the judge or hearings officer.
  • Withdrawn: The person who submitted a complaint to RICO/OCP against a Company or Individual withdraws his/her complaint.

Remedy: Type of action ordered against a Company or Individual and the effective date and terms of the actions ordered.

Types of remedies (click to expand/collapse)
  • Injunction: Occurs when a Company or Individual must stop engaging in a particular conduct for a specific period of time.
  • Monetary sanctions: A listing of the amounts of any fines, restitution, or costs that a Company or Individual has been ordered to pay and any suspended amounts.
  • Revocation: Occurs when the license of a Company or Individual is taken away or revoked for at least a five-year period.
  • Suspension: Occurs when the license of a Company or Individual is taken away for a period less than five years.
